SERVICE WARRANTY TERMS AND CONDITIONS

Warranty Period*: 

The warranty provided herein for the ESL, Access point(if applicable) shall be limited to manufacturing defects, for a period of twelve (12) months, from the date of purchase (i.e. from the date of invoice raised by Sparsa Digital Pvt Ltd. Warranty for the accessories, which includes power adapter is limited to 6 months. It is subject to the authorised service personnel of Sparsa Digital Pvt Ltd., on examination, certifying the ESL, Access point Hardware defective due to manufacturing defect. In other cases, any repair/ replacement/ service of the component of ESL/Access point would be chargeable to the customer.

Product Acceptance

The Client shall inspect and test the Product upon installation. Unless the Client notifies the Supplier in writing of any defects, non-conformities, or issues within seven (7) calendar days from the date of installation, the Product shall be deemed accepted and fully compliant with the agreed specifications. Any claims made after this period shall be treated as a warranty request and addressed in accordance with the Warranty Terms.

Warranty Details:

1.1 Warranty Terms and Conditions

  1. This warranty is confined to the first purchaser of the product only.
  2. Repair or replacement will be carried out through the Company’s Own Authorised personnel only.
  3. For the units installed beyond the municipal limits of the jurisdiction of the Company’s Authorized Service personnel, all expenses incurred in collection the unit or part/s thereof from the Company’s Own / Authorized Service Centre as well as expenses incurred for deputing of service personnel / technicians towards to and from travel, conveyance and other incidentals etc. will be borne by the customer. (Municipal Limits is defined as 25 Kms range of the Company’s Own / Authorized Service Centre / Location of Authorized personnel) .
  4. In the event of repairs / replacement of any part/s of the unit, this warranty will thereafter continue and remain in force only for the unexpired period of the warranty. Moreover, the time taken for repair / replacement and in transit whether under the warranty or otherwise shall not be excluded from the warranty period. If the delay in service is more than 15 days than those number of days to be extended in the remaining warranty.
  5. The company or its authorized service centre/personnel, reserves the right to retain any part/s or component/s replaced at its discretion in the event of a defect noticed in the equipment during the warranty period.
  6. ESL / Access point warranty covers:
    1. Manufacturing defects in hardware components.
    2. Display failures (fading, non-refreshing, or dead pixels beyond acceptable limits).
    3. Communication failures due to hardware defects.
    4. Battery performance failure within specified life cycle parameters. Sparsa Digital warrants that the battery will meet the specified performance and capacity parameters for 4 updates/day under normal operating conditions subject to the condition that the LED light blinkers connected to the battery are not used as defined in the Product Specification Documents.
  7. Intimation for change of address where ESL / Access point  is installed :
    1. Any change of address where ESL / Access point Hardware is installed shall be intimated to the concerned Service Centre for continuation of warranty.
    2. Warranty for the unexpired period shall continue after the product is inspected by the concerned Service Centre/personnel and the product is found free from transit damage. The customer shall have to pay a visiting charge towards inspection, as applicable.
    3. In case of any transit damage, the product shall be repaired by the concerned Service Centre/personnel on charges and warranty for an unexpired period to continue.
  8. The company’s obligation under this warranty shall be limited to repair or providing replacement of part/s only. The maximum claim/s if entertained by the company will be subject to the maximum retail price of the product purchased or the purchase price, whichever is lower.
  9. In the event of any unforeseen circumstance, and spares not being available, the company’s prevailing depreciation rules (@ 33% per year) will be binding on the purchaser to accept as a commercial solution in lieu of repairs.
  10. The warranty does not cover any accessories external to the system.
  11. The company’s obligation under this warranty shall be limited to repairing or providing replacement of part/s, which are found to be defective.
  12. Repairs during warranty period shall be carried on “onsite” basis or at purchaser’s warehouse. Wherein for service the purchaser shall bring the product to the Service Centre with whom the set is registered for warranty service, applicable only in cases where the service location falls under municipal limits of  Company’s Own / Authorized Service Centre / Location of Authorized personnel. .
  13. The concerned Service Centre/Authorised personnel will advise the customer whether to complete the repair at site/Purchaser Warehouse or its Service Centre.
  14.  Any part/s of the system replaced by the company at its discretion shall be with a functionally operative part.
  15. If hardware failure is found within 7 days from the first sale date then defective product shall be considered as DOA(Dead on Arrival). Under DOA, products shall be replaced with ETN/Fresh whichever is available. (ETN: Exchange Trade Note)
  16. Only conceal damage shall be considered under transit damage (TD) but the date of purchase should be within 7 days from the first sale.
  17. The warranty is issued at Gurgaon, and Courts at Gurgaon shall have exclusive jurisdiction over matters covered or flowing from this warranty.

1.2 Warranty not applicable in below conditions

  1. The product is not purchased from Sparsa Digital Pvt. Ltd.
  2. The product is not used as per the instructions (enclosed Annexure 1).*
  3. Defects caused by improper use as determined by the company personnel.
  4. Modification or alteration of any nature is made in the electrical circuitry / physical construction of the set.
  5. Repair work is carried out by persons / agencies other than authorized by the company.
  6. Site (premises where the product is kept) conditions that do not confirm to the recommended operating conditions of the machine (enclosed Annexure 1)*.
  7. The original serial number is removed, obliterated or altered from the machine or cabinet.
  8. In case of defects or faults in the ESL or Access Point hardware caused by accident, lightning, fire, rodents, water, Force Majeure events, or any other external factors beyond the control of Sparsa Digital Pvt. Ltd.
  9. In case of any damage to the ESL or Access Point hardware resulting from adaptations, modifications, or adjustments made by the purchaser or any third party, the warranty shall be deemed void. The warranty shall also not cover any accessories external to the ESL or Access Point hardware, nor shall it apply if the ESL or Access Point hardware is connected to any accessories or equipment not expressly approved by Sparsa Digital Pvt. Ltd.
  10. In case of Components subject to normal wear and tear, such as, rubber and glass/fiber/plastic items, including expected battery depletion.
  11. Warranty does not cover any type of claim in relation to nullification, depreciation, financial recompense arising as a result of repairs carried out by third party and claims In respect of damaged articles etc.
  12. In the event that the ESL or Access Point hardware is used for personal, commercial, or trade operations beyond the specific purpose for which it was supplied, the warranty shall stand void and shall be deemed unenforceable against Sparsa Digital Pvt. Ltd.

Note : 

  1. The above policies are for warranty service and the customer will be responsible for any costs associated with non-warranty conditions.
  2. Sparsa Digital Pvt. Ltd. reserves the right to make final decisions regarding problem determination and the appropriate service option, subject to change without prior notice.

1.3 General Terms and Conditions for Warranty 

  1. This warranty is applicable only on Invoice with valid GST no.,Product Serial numbers as mentioned in Annexure-2
  2. Original warranty is non-transferable and shall not be considered in case of any resale.
  3. Any change of address must be notified by the customer in advance to avoid any inconvenience and delay.
  4. Upon receipt of a complaint, the authorised service personnel of Sparsa Digital Pvt Ltd.  shall inspect/examine the supplied Hardware  subject to the authorised service personal of Sparsa Digital Pvt Ltd., certifying the supplied Hardware  to be defective due to manufacturing defect, Sparsa Digital Pvt Ltd. would repair or replace the Digital supplied Hardware and if at the sole judgement of Sparsa Digital Pvt Ltd., replace the supplied Hardware , if necessary, free of cost. In such cases, Sparsa Digital Pvt Ltd. would replace the supplied Hardware  with an identical model if available at the relevant time and in case of non- availability or phasing out of the model, Sparsa Digital Pvt Ltd.  may at its sole discretion replace the supplied Hardware with a model with similar functions. It is specifically stipulated that the purchaser would have no right to insist on replacement of the supplied Hardware with an identical model in addition.
  5. Company shall endeavour to give preferential attention to emergency breakdown of the product, however Company shall not be responsible for any such loss or damages beyond warranty
  6. The warranty shall become invalid in the following cases:
  • Community / Public usage etc.
  • Alteration or modification of the Product.
  • Damage caused by accidents, theft, riots, natural disasters etc.
  • Accidental or internal damage due to electrical power inadequacy or fluctuating electrical power conditions including voltage fluctuation, short circuit or earthing issues.
  • Damage to Product incurred while moving the equipment from one location to another or re- installing it
  • Any repair carried out by a person other than from an authorized Sparsa Digital Pvt. Ltd. Service Center/authorized personnel
  1. Any disputes arising out of the warranty shall be exclusively settled at the Courts of Gurgaon

1.4 WARRANTY DISCLAIMER:

There are no express warranties other than those listed and described above, and no warranties whether express. or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose, shall apply other than the express warranty conditions and period stated above and no other express guarantee or warranty given by any person, firm or corporation including the Dealer/ Distributor/ Authorized Service Provider/Personnel with respect to the supplied Hardware shall be binding on Sparsa Digital Pvt Ltd.  shall not be liable for loss of revenue or profits, failure to realize savings or other benefit, or any other special, incidental or consequential damages caused by the use, misuse or inability to use this Hardware, regardless of the basis on which the claim is based.

Annexure 1

Instructions of operation of the hardware product

  1. Hardware is strictly for indoor use, with these as recommended environmental conditions:

Operating Temperature 0 °C to 40 °C
Humidity Store in a clean, dry environment—avoid high humidity and condensation
Exposure Do not expose to extreme heat, direct sunlight, or freezing conditions
Battery Life Store in moderate temperatures to preserve battery health and longevity
  1. Safety usage conditions :  
    1. Easy plugin HDMI & Power adapter, Plug out only when instructed by Sparsa authorized representative
    2. There should be no direct contact of the Digital Display/Kiosk Hardware with water
    3. Do not use the Hardware under direct sunlight
    4. Do not open the Hardware in any case.
    5. Do not cut any wire and cable associated with the Hardware and other accessories.
    6. Do not plug any hardware in the SD card slot or USB slot that is not provided /approved by Sparsa Digital Pvt Ltd.
    7. Do not apply any direct weight on the supplied Hardware 
    8. Store the supplied Hardware safely under normal environmental conditions.
  1. Use standard accessories only provided along with the Hardware or separately supplied by Sparsa Digital Pvt Ltd.
